Washington: The Donald Trump administration has issued new guidelines for H-1B visas. Regarding the $100,000 fee, it has been clarified that not all applicants will be required to pay this fee. H-1B visa holders will not be required to pay the increased fee for status changes or extensions. This brings particular relief to Indians, as they are the largest applicants for this visa. Last year, 70 percent of all approved H-1B visa holders in 2024 were Indian-origin employees. India represents the largest number of skilled professionals, and as such, they have the highest number of pending applications.
The guidelines issued by the US Citizenship and Immigration Services (USCIS) clarify the exemptions provided in President Donald Trump's September 19 order banning the entry of non-immigrant workers. It said that the fee of US$100,000 (Rs 88 lakh) on H-1B visa applications in the US will not be applicable to applicants who want to change their status or extend their stay.
USCIS has stated that Trump's increased US$100,000 country mandate on H1-B visas will not apply to previously issue and currently valid H-1B visas or applications submitted by September 21. USCIS clarified that there are no restrictions on travel to and from the US for existing H1-B visa holders.
USCIS's new guidelines on H-1B visas come after the US Chamber of Commerce filed a lawsuit against the Trump administration over the new rules. The organization said the increased fees would harm American companies. The major business organization called Trump's September 19 order legally invalid.
While signing the order, Trump stated that his initiative was aimed at giving Americans priority in jobs. Other foreign workers and companies have expressed concern. Indians are particularly affected, as more than half of those employed in the US through H-1B visas are Indians.
